Edward Mc Millan-Scott,Vice-president of the European Parliament, has opened a Board of Inquiry on the dysfunctions related to parental abduction

The Vice President Mc Millan-Scott was alerted by two parents living in Brussels, whose children are retained illegaly in Germany, one for four years; the other for ten years.

The facts are obvious: The child must be returned to his parent within  six weeks of the submition of the case into the court. They are thousands of victims in Europe whose rights are denied.

The Vice-president met this 25 April, 2006, with various Belgian and Dutch members of associations.

Child Focus, the General Delegates to the Right of the child and the representatives of the ministries for justice were absent. The press was also absent, except television ARTE, in the framework of a report on a mother. Has there been pressures to hush-up the news of the Board of Inquiry regarding the dysfunctions related to parental abduction ?

Courteous, witty and deeply human, Edward Mc Millan-Scott is married to a lawyer who is a specialist in the rights of the child, the reason why he is particularly touched by all the questions referring to childhood. He is close to Mr. Frattini, Minister of Italy, then Vice President of the European Commission, in charge of justice, freedom and security. 'The Vice-president Frattini is founding a project aiming at fighting the parental abductions as well as the paedophile networks', explained Edward Mc Millan-Scott and so he opened the Board of Inquiry on the Parental alienation day: a  crime consistent in a brain washing implemented by a parent on a child, which is frequent in situation of parental abduction.

Three lawyers’ offices, forming the Board of Inquiry of the European Parliament were represented. Their names are kept secret, this in order to avoid publicity and the potential attempts to pressure them. Only there nationalities are known: they are Italian, English and American. Several files were given to the lawyer. Five parents briefly summarized their aberrant situations.

A number of difficulties are also noted at the local level, for example owing to the fact that parents under the effect of international mandates travel freely. The owners of brothels wanted by the European police forces are an obstacle that also arises in the problems of the paedophile networks that are prosperous and openly living in exotic countries where they arrived by plane.

"There is no sense in drawing international mandates if the countries that are members of the Union let the criminals travel as freely as they want,� explained S.O.S Parental Abductions.

"Belgium is shown for having chronic dysfunctions in regards to solving parental abductions, strangely enough by the same magistrates and state organisations, which block the inquiries on paedophile networks", explained the Foundation Princess of Croÿ. Vice President Mc Millan-Scott lifted an eyebrow, obviously very puzzled by this coincidence, and asked for an explanation.

They are indeed the dysfunctions of the same magistrates and the same organisations in an amazing number of files that had joined the associations of fight against paedophile networks and parental abduction.

Germany is the bad pupil, providing its social services an annual sum exceeding 28 million euro,  increasing proportionally to the number of abducted children and diminishing when the problems are solved, giving a financial interest in maintaining a maximum number of children in situations of parental abduction.

Italy was highly criticized. Last year, a fifteen-year-old American girl had to do 100 kilometres to take refuge in her consulate in Rome chased by her father and a welfare officer. She chose to hide in the toilets of the airport, to be ensured she could take the plane and return to her mother. The joy was followed by an abominable surprise: the child had been prostituted, under the protection of a 35- year-old neo-Nazi punk. Since he seeks by all the means to recover his "merchandise", promising her marriage and sending her the plane ticket, while the father sends her an Italian passport, so she can leave the United States without the agreement of her mother. The American, Italian and European laws presently allow this. The child was so alienated during the abduction, that she is now convinced that her mother wants to sabotage her marriage, which infuriates her. The British phlegm of the Vice President Mc Millan-Scott was put at hard test, and he asked again how old she was.

In 6 P.M. he had an appointment with Mr. Herman De Croo, President of belgian Chamber and also President of the committee of federal opinion in charge of European Questions, and promised to insist that he give attention to the parental abductions.

"Could you also insist that he gives attention to the paedophile networks?" asked Princess of Croÿ. "Yes, of course", he answered.

Dear OHCHR,

Today 25th of April is International Parental Alienation Awareness Day, concerning a very serious matter, a life trauma that we could so easily protect our children and families from.

Each letter you will be receiving from us will be on the same topic. Please note that on some of the envelopes the stamps have a child's face on. Each face is the face of a victim of a kidnapping, a victim of parental alienation. Each child is the child of a parent who is writing to you.

As you probably know, American and Canadian judges in an expanding number of states take the matter very seriously and a parent who alienates a child from the other parent can face up to two years in prison. In the rest of the world, very little if anything substantial is yet being done to protect children and adults from the dangers of such mistreatment.

It is a desperately sad situation of social rejection to create for a family, in particular children who even as grown-ups can be shattered by the realization that the parent they have been taught to despise or hate was just a parent who loved them. Experts on this pathology are increasingly disturbed by its spread and depth, as it has disastrous consequences for social cohesion and the integration of all ages and both sexes in the wider community.

We, parents and victims, ask you the following: please protect our children, victims of parental alienation. In order to protect human rights, one ought to protect, first and foremost, children's rights to their family. We ask:

1. For enhanced and decisive regulatory decisions such that it is recognised that a child has the right to both parents, and that such family ties must be protected.

2. That child abduction or obstruction of contact should be recognized as human rights abuses under both national and international law, whether practised by parents against each other or by officials against an individual parent, so that an alienating parent or an alienating official can be taken to court and tried for these crimes, with the degree of alienation taken into account, thereby tilting the balance in favour of caring parents, irrespective of their sex.

3. That items 1 and 2 be integrated into the framework for dealing with both international and domestic child removal. For too long we have lived under a child abduction régime.

4. Concerning non-respect of contact rights and parental kidnappings to which a blind eye is turned by the judiciary, in order to get conventions and laws on co-parenting to be respected, we must have a "no-delay" justice system where non-compliance is felt to be a risk. It is not acceptable that a judge delays reaching judgment when such delay may result in extended periods of loss of contact. Neither the children, nor we, have the time for this any more.

We hope, dear Sir or Madam, that you will do your best to prevent parental alienation, so that we and our children can have our own cultural values respected as well as all our other human rights, as human beings, with human families, and so that we no longer have to go through this ordeal.

Germany and Human Rights Abuse are together, alive and well. Or perhaps they simply missed the course on jurisprudence - certainly their judgs know how to write a proper Order, but they will not lift a finger to enforce it. Germany needs special assistance to help them start over with their court system.

I had purchased the tickets, but their father said their passports had been lost, not to worry because I could pick up the children and return them to the United States during the summer. I traveled to Italy on July 4, 2005, thinking that it would not be a problem to get my children. Thursday, May 11, 2006 Laura Sweeney Response Regarding Statements by U.S. Office of Children's Issues Dear Sirs: Here is my response to the U.S. Office of Children's Issues. I believe I and my family are victims of crime abroad and that I do retain a valid custody order that, by law, should be recognized by the Italian Government. The children are retained merely for the money they provide to Gennaro Villa, and they are afraid of their father so they cannot speak up. “The Rome Juvenile Court ruled the habitual residence of the children to be Italy and thus did not order the return of the children to the United States. The court gave the following reasons: the children came to Italy with their mother’s consent; the children have lived in Italy for two years and have attended Italian schools; and, finally, the children expressed to the Court their desire to remain in Italy with their father. The court published its ruling on October 20, 2005. The Office of Children’s Issues reviewed the translation of the Hague ruling to ensure that the court ruled in compliance with the Hague Convention. No irregularities were found.� The children went to Italy with the agreement they would return to the United States. They only went to Italy to learn some Italian and get to know their family, but the Italian family later changed their telephone numbers to interfere with my custtody. Two years had not passed when the children were supposed to get on the jet on March 5, 2005. The children should have returned sooner than that. In fact, I telephoned the U.S. State Department with a concern in January 2005. I thought Gennaro was honest about returning the children and had faith in him until July 7, 2005. DeGuidi and Bianchi stated that the abduction occurred when the children didn’t get on the plane in March, and the children should have only been retained if the children were endangered by their return to the United States. I don’t care what the children “said in court.� They were blocked from communication with their mother, and they were in the hands of Carletti and Villa. My son told me he knew his father would find out whatever his response was. The children would be punished if they said they wanted to return to the United States. Giovanni made a run up the hill to Bar Matisse in Fiuggi where he called my attorney asking for a U.S. Passport; Giovanni also telephoned the U.S. Embassy in my presence. IT IS AGAINST THE LAW TO REMOVE ANY MINOR FROM THE UNITED STATES WITH THE INTENT TO TAKE AWAY CUSTODIAL OR NON-CUSTODIAL RIGHTS. I did not fly with the children to Europe, so Mr. Gennaro Villa has the responsibility of returning Giovanni and Carmen. If Gennaro Villa reported I abandoned the children, that is because he and Carletti could not apply for welfare monies since I had a job. When I reported (July/August 2005) what occurred to the Walton County Sheriff’e Department, they would not file an arrest warrant for Mr. Gennaro Villa, nor would the local District’s Attorney act upon my complaint, nor did they seek to find Andrea Verrechio, the Internet pedophile who had already been involved in a relationship with my daughter. They said this all occurred in a foreign country, and there was nothing they could do. “Ms. Sweeney informed the Office of Children’s Issues on February 21 that she was petitioning the Italian court for a custody order with the assistance of her Italian attorney. By selecting this course of action, Ms. Sweeney acknowledges and accepts the Hague decision giving jurisdiction over the children.� I told the U.S. Office of Children’s Issues that Giorgio Gagliardi was searching for a victim’s defense attorney. I said my American custody is still valid in Italy. I had previously stated my attorneys, DeGuidi and Bianchi, refused to file an appeal although they had received 6 thousand dollars for their services. I don’t accept the Hague decision and know there was an Italian clan that ganged up on the attorneys. At some point, I explored the possibility of seeking custody, but I realized it would be absurd to seek what I already possessed. Sweeney Laura Gail, Nonché i MINORI: Francesca Valentina Villa, Giovanni Victor Villa e Carmen Lydia Villa Contro: Gennaro Villa residente in Fiuggi, Via Vallicelle XXXXXXXXX MEMORIA INTEGRATIVA Ad Integrazione di quanto già esposto nel ricorso introduttivo riteniamo doveroso con le presenti memorie formulare le seguenti osservazioni su alcuni punti determinanti: 1) IN ORDINE ALL’ASPETTO TEMPORALE DELLA DOMANDA: l’art. 12 della convenzione dell’’Aja, così come recepito dalla L. 64/94, stabilisce che se la richiesta di ordine di rientro è presentata oltre l’anno dal trasferimento illecito il giudice o l’autorità amministrativa non è tenuta a ordinare il rientro, solo se è dimostrato che il minore si è integrato nel suo nuovo ambiente (art. 12, 2º comma) ovvero se il ritorno del minore può essere contrario ai principi fondamentali relativi alla protezione dei diritti dell’uomo e delle libertà fondamentali (art. 20).Ciò significa, ovviamente, che, nel caso non sussistano tali ragioni ostative, il Tribunale può disporre ugualmente il ritorno dei minori (v. Cass. 944/98, Cass. 13657/99). Sul punto è illuminante la Sentenza qui di seguito riportata: “Nell’ipotesi in cui un minore, residente negli Stati Uniti d’America, viva di fatto, ma senza che vi sia alcun accordo al riguardo tra i genitori, stabilmente con la madre, limitandosi il padre ad andarlo a trovare in casa dei genitori della moglie ed a tenerlo con sé nelle giornate libere da impegni di lavoro, e, ad un dato momento, la madre si trasferisca con il figlio in Italia senza il consenso del marito, e quest’ultimo, dopo un mese dal trasferimento del minore, ottenga, nel corso del procedimento di separazione personale promosso dalla moglie negli Stati Uniti, un provvedimento giurisdizionale di affidamento del figlio in via esclusiva, ben può egli ottenere dal giudice italiano la tutela prevista dalla convenzione de L’Aja 25 ottobre 1980 (ratificata in Italia dalla l. n. 64/1994) sugli aspetti civili della sottrazione internazionale di minori: l’art. 3, lett. b), ultima parte di tale convenzione qualifica, infatti, illecito il trasferimento del minore se esso avviene in violazione dei «diritti di custodia» assegnati ad una persona, diritti il cui esercizio, in concreto, sia stato impedito dalla sottrazione illecitamente consumata; né rileva in contrario che l’azione sia stata proposta dal p.m. (cui gli atti siano stati trasmessi, come previsto dall’art. 7 legge di ratifica della convenzione, dall’ufficio centrale per la giustizia minorile del ministero di grazia e giustizia, quale autorità centrale ai sensi della convenzione cit.) dopo un anno dalla sottrazione illecita, poiché l’art. 12, 2º comma della convenzione de L’Aja, limitandosi ad escludere che, trascorso tale periodo, l’autorità giudiziaria dello stato richiesto sia obbligata ad ordinare il rimpatrio del minore, benché risultino integrati i presupposti dell’illecita sottrazione, lascia all’autorità dello stato richiesto un ampio margine di discrezionalità nel valutare l’opportunità di accogliere, comunque, la domanda, sicché ben può il giudice disporre il ritorno del minore se, considerando anche la sua età (nella specie, sei anni), l’interruzione delle relazioni intrecciate dal minore in Italia non sia per lui traumatica, mentre, al contrario, risulti per lui vantaggiosa la ripresa del suo rapporto con l’altro genitore�(c. Tr. Minori Messina 06/03/1999). Nel caso di specie, riteniamo non sussista alcun fondato rischio per i minori di essere esposti, per il fatto del loro ritorno, a pericoli fisici e psichici o comunque a rischio di trovarsi in una situazione intollerabile (art. 13, 1º comma lettera b della convenzione). Al contrario, invece, la permanenza dei minori in Italia e il conseguente ulteriore distacco dalla madre e, ora, anche dalla sorella, creerebbe agli stessi, già fortemente provati, una situazione d’ulteriore disagio fisico e psicologico. Alla luce di tali premesse in fatto ed in diritto, riteniamo censurabile un eventuale rigetto del presente ricorso, fondato solo sulla pretesa rilevanza del fatto che i minori si trovino in Italia da oltre un anno. Tale valutazione, infatti, non deve essere compiuta per decidere quale dei due genitori sia più idoneo ad occuparsi dei figli, ma per verificare se dal ritorno presso la madre possa derivare ai minori un pericolo sul piano fisico o psichico, verifica consentita, peraltro, dall’art. 13 della convenzione solo nel caso in cui vi sia opposizione da parte di uno dei coniugi e questi dimostri l’effettivo pericolo (v.Cass., sez. I, 23-09-1998, n. 9499). 2) MANCATO ASSOLVIMENTO DA PARTE DEL RESISTENTE DALL’ONERE DELLA PROVA: l’art. 13 della medesima convenzione, infatti, pur introducendo alcune deroghe al dovere dello stato, che ne sia richiesto, di ordinare l’immediato rientro del minore nel proprio stato di residenza abituale, in caso di suo trasferimento illecito, impone a colui che si oppone a detto rientro l’onere di dimostrare la sussistenza di una delle circostanze previste dalla medesima norma. Orbene, nel caso di specie nessuna prova sul punto è stata fornita dal Sig. Villa che, peraltro, senza alcun pregnante motivo, non è comparso alla scorsa udienza, confermando l’insussistenza d’ogni ragione ostativa al ritorno dei minori dalla propria madre. Peraltro, nel procedimento di cui si tratta, al pari di quanto è previsto in relazione a tutti i procedimenti in camera di consiglio, il giudice può decidere sulla base di semplici «informazioni», senza che sia necessario il ricorso alle fonti di prova disciplinate nel libro secondo del codice di procedura civile ( Cass., sez. I, 23-09-1998, n. 9499). 3) CIRCA L’ INSEREIMENTO DEI MINORI IN ITALIA: infine, su tale ultimo punto, riteniamo che la documentazione in atti del Tribunale adito, consenta di escludere, anche alla luce degli ultimi accadimenti, qualsiasi elemento che possa far ritenere positivo l’inserimento dei minori in Italia. Al contrario, l’ulteriore permanenza dei minori in Italia riteniamo possa arrecare agli stessi un grave danno, sia per il tipo di modello educativo ad essi impartito dal padre, sia per il disagio economico in cui i medesimi sono costretti a vivere. I numerosi allontanamenti della maggiore dalla casa del padre sono indice proprio di tale tenuto danno, anche in considerazione del fatto che l’ eccessiva libertà di movimento concessa a Francesca ha poi condotto la bambina ad una serie d’esperienze devastanti culminate in pericolose relazioni sentimentali e di amicizia. Risulta, infatti, da informazioni assunte e rese note anche agli assistenti sociali di Fiuggi, ma da essi mai riferiti alla madre né riportati nelle proprie relazioni, che la minore, spesso dedita all’accattonaggio ha poi intrattenuto una relazione completa con un uomo di circa 35 anni e che da detta relazione ne è derivato un temuto stato di gravidanza. Si capisce, peraltro, in tale contesto, come, in realtà, la volontà della stessa bambina, di rimanere in Italia con il proprio padre sia frutto di un condizionamento esterno, lo stesso, peraltro, subito dai piccoli Giovanni e Carmen, a cui è stato sempre proibito di avere incontri con la propria madre fuori dalla vigilanza del Sig. Villa e, proprio in questi giorni, in prossimità della presente udienza, è stato loro inibito ogni contatto telefonico con la stessa: Si comprende, altresì, perché Francesca -ma riteniamo che questa sia anche la reale volontà dei più piccoli- si è poi spontaneamente allontanata dal di lei padre per ricongiungersi con la propria madre. Peraltro la permanenza dei minori in Italia dovrebbe essere scongiurata, oltre dalla poca attitudini educative del Sig. Villa, anche della sua situazione economica, in quanto l’inidoneità a garantire adeguate condizioni, anche materiali, d’accudimento dei minori è circostanza che li espone a pericoli fisici o psichici. Vero è, infatti, che il Sig. Villa, come dal medesimo dichiarato agli assistenti sociali, risulta essere disoccupato, sicchè nel caso di specie assume rilievo anche la valutazione della situazione economica dello stesso, proprio perché l’insufficienza delle risorse economiche, indipendentemente dalla ricerca della cause e degli strumenti per ovviarvi, può indubbiamente esporre i minori a pericoli fisici o psichici. P.T.M. S'insiste affinché l’Ill.mo Tribunale adito, in esecuzione della convenzione dell’Aja, ratificata in Italia dalla L. 64/94, Voglia, d’urgenza, emettere ogni idoneo provvedimento onde consentire ai minori di ricongiungersi con la di loro madre e con la propria sorella. Maurizio Bianchi posted by LauraInMonroe at 9:31 AM 0 comments Actual Court Papers stating Children Are Endangered in Fiuggi with Gennaro Villa Tribunal for the Minor of Rome Procedure 1824/05 For Ms. Laura Gail Sweeney As well as the MINOR: Francesca Valentina Villa, Giovanni Victor Villa and Carmen Lydia Villa Against: Resident Villa Gennaro in Fiuggi, XXXXXXXXXXX SUPPLEMENTARY MEMORY To add to all that was already exhibited in the introductory recourse we find it necessary with the present memories to express the following observations on some important points: 1) IN RESPECT TO THE TEMPORAL QUESTION: the art. 12 of the Hague convention, how it is understood from the article L. 64/94, establishes that if the request of order of return is presented beyond the year from the illicit transfer the judge or the administrative authority is not held to order the return, but only if it is shown that the minor has integrated in his or her new environment (art. 12, 2º Subsection) and that is if the return of the minor is to be opposed to the fundamental principles relevant to the protection of the rights of man and against rights of mankind and of fundamental freedoms (art. 20). That it means, obviously, that, in this case there are not such obstacles, and the Tribunal can arrange equally for the return of the minors (v. Cass. 944/98, Cass. 13657/99). Regarding this point the Sentence reported here is illuminating: “In the hypothesis in which a minor, resident of the United States of America, living, but with an agreement of the parents, stable with the mother, limiting the father to go find children in the house of the wife and to hold them with him in the free days from work engagements, and, to a given moment,she Approves of the husband, and this last, after a month from the transfer of the minor, obtains, in the course of the personal procedure of separation promoted from the wife in the United States, a jurisdictional measure of custody of the exclusive road, he is quite able obtain from the Italian judge the protection expected from the convention says THE Hague 25 October 1980 (ratified in Italy from the l. 64/1994) on the civil appearance of the international subtraction of minor: the art. 3, lett. b), finishes part of such convention qualifies, in fact, the illicit transfer of the minor if it happens in violation of the «right of care» of an assigned person, whose right exercise, in concrete, has been hindered from the subtraction illicitly consumed; neither points out in opposite that the action has been proposed from the p. m. of whom the actions they were transmitted, how expected from the art. 7 law of ratification of the convention, from the central office for the juvenile justice of the ministry of charm and justice, what central authority to the senses of the convention cit.) after a year from the illicit subtraction, since the art. 12, 2º subsection of the convention says THE Hague, limiting excludes itself that, such mistake period, the authority legal of the state asked for is obliged to order the repatriation of the same minor, although he results integrated in the premises of the illicit subtraction, leaves to the authority of the state asked for a spacious margin of discretionary power in the appraisal the opportunity to welcome, however, the question, so quite the judge is able to arrange the return. The interruption of the connections interwoven by the minor in Italy will not be traumatic for him, while, to the opposite one, you result for him advantageous the renewal of its relation with the other parent�(c. To the light of such introductions in fact and in law, we retain censurabile an eventual rejection of the present one and has a new direction, that has been based on only the claimed importance of the fact that the minors find themselves in Italy from beyond a year. Such evaluation, in fact, does not have to be finished to decide which of the two parents it is fitter to occupy itself of the children, but to verify if from the return to the mother, the minor can be in danger of physical or psychological pain, It checks agreed, moreover, from the art. 13 of the convention that only in the case in which opposition is shown that one of these spouses presents the real danger (v. Cass., sez. He told my children to lie to their mother, saying that their passports were lost during the move from one house to another. In good faith, I travelled to Italy on July 4, 2005, with the intention of returning my children to America after having had spent a period of vacation/holiday with them. I did not understand that Gennaro Villa had severe problems especially since he even said he wanted to remarry. I understood that he would have sold the house in Rome to buy another, smaller house in Fiuggi. I thought he had a job and that we got along, but, instead, I found I was no longer welcome, all the money was spent, he did not work, and my children lived with the assistance of social services. After two days, I was run out of the house and threatened to be killed in front of my children if I were to take them away. Mi sono recata dalla polizia (col' aiuto di Fiuggini) a lamentarmi che Gennaro mi aveva minnacciata davanti ai miei figli, pero' loro non facevano nulla; cosi' l'Ambasciata USA ha chiamato il giorno dopo alla polizia dicendo che era contro la legge non fare una denuncia anche quando la vittima era straniera. Dopo, ho dovuto dormire o in albergo o a casa di nuovi amici conosciuti a Fiuggi perche' non potevo piu' stare con i miei figli. Scioccata, sono andata da Ciocceria d' Oggi a spiegare la mia storia e come era incredibile che solo perche' apprezzavo l'Italia e la sua cultura, potevo perdere I miei figli-che c'era ironia in questo, e che non potevo lasciare i miei figli. Afterward, I had to sleep either in a hotel or at the house of new friends that I met in Fiuggi because I wasn’t permitted to stay with my children. Shocked, I went to the newspaper, Ciocceria di Oggi, to explain my story and how it was incredible that only because I always loved Italy and its culture, I could end up losing my children—that there was irony in this and that I couldn’t leave my children. Pero' avevo sentito dai servizi sociali (sottovoce, che parlava con altre persone)che potevo-per legge-portare via i miei figli siccome in luglio avevo ancora in mano un ordine dal giudice Americana (Waycross, Georgia) affidandomi I miei figli perche' tenevo sempre un lavoro stabile. Il Tribunale dei Minori in Roma non avrebbe dovuto portare Francesca davanti al giudice in maggio senza avermi avvisata, ma l'hanno fatto lo stesso perche' ero straniera ed indifesa. Loro erano in difetto, ma la Polizia di Fiuggi, Gennaro, ed I servizi sociali mi hanno tolto I miei diritti come mamma solo perche' ero straniera e possibilmente non avrei capito. Mi hanno costretto a tornare in America senza figli, e dovevo prendere avvocati costossissimi a difenderci. The police and social services advised me that my daughter, Francesca, had been taken to the judge in Rome, to the Tribunal of Minors, because she escaped from her father’s house in March 2005. The police said I could not take Francesca, Giovanni, and Carmen because they had been taken to the judge in Rome, and we had to await his decision; however, I had already heard from the social services worker (whispering, speaking to another person) that I could—by law—take my children away because, in July, I still had the USA-judge’s order (Waycross, Georgia) that gave me sole custody of my children due to the fact I had a stable employment. The Tribunal for Minors in Rome, Italy shouldn’t have taken Francesca to court in May without having advised me first of this fact, but they did it regardless because I was a foreigner and couldn’t easily defend myself. They were in defect, but the Fiuggi Police, Gennaro, and social services took away my rights as a mother only because I was a foreigner and possibly because I didn’t understand. They forced me to return to America without my children, and I had to find expensive attorneys to defend me. When the bus driver wanted to stop the bus because of her father’s request, Francesca yelled, “I’m American. I don’t know that man! Leave me alone because I want to go to the American Embassy!� For 14 hours, she had to hide in a restroom, and she had to beg the airlines to let her get on the jet because she was only 15-years-old and wanted to return to her mother. He prohibits them from having contact with their American family by means of e-mail and telephone. Francesca explains that they are not permitted to speak English and that the father says the mother only loves work and her students. I try to make contact, but it is sad when I am successful and I hear the father yell at my children because they express emotion. I understand how difficult it is to to leave Italy with its beauty, warm people, and wonderful cuisine; however, it’s not good that Giovanni and Carmen live in a home with an aggressive father who doesn’t work and who spends social services’ money. They took photos that helped reassure me that my children are physically okay. The children appeared to be timid and quiet but in good health. Their father said he was not considering going out of the country. Both I and Francesca were glad he had decided to remain in Italy rather than take the children to Egypt. This is not the end of my children's story. I will continue to report on what little I hear of my children as time goes by. I still have hope that the children will return to the United States where they first attended school and learned their first language. Francesca, for the time being, is employed and is considering a degree in digital arts. Naturally, I hope she will pursue her studies. This doesn't come easy after her experience in Europe. As time passes, I try to look at this abduction/retention from a rational perspective with my own children involved. Visiting Italy has been shocking to me because I was previously unaware of the public acceptance of domestic violence and male dominant control and the fact that I had little protection as a foreigner. Sweeney versus Villa: Abduction in Fiuggi

To whom it may concern: Some in law enforcement and at the Office of Children Issues do not understand that the Mother and Father both were properly divorced in Waycross Georgia under the UCCJEA. The civil action in Italy have not in any way diminished the sustaining jurisdiction of the Georgia Courts. There has been no final hearing in the Hague Treaty Central Authority nor can the USDOS Office of Children Issue "order" the USDOJ or any other Law Offices to cease discover of evidence that would support a Grand Jury at the State or Federal Level to take place. I am seeking the action tribunal records that exist in Italy now to further support this position. I also have attach some emails from European Officials who have also assured me that Dr. Sweeney has lawful right to be with her minor children. Under US Federal International Parental Kidnapping Statutes there are no special circumstances for defense that allows for due process to be suspended or avoided as has been done in the aforementioned case. I would hope that Law Officials not only at the state level in Georgia but also by those in law enforcement at the Federal level be directed to provide not only your office of the United States Attorney General Office but also at the Georgia's State Attorney General Office with evidence that exists of the felony crimes committed by the ex husband Mr. Ville in the matter of his children with Dr. L. Sweeney. Notice the complexity of this matter and how it relates to the various US Constitutional powers granted to the three branches of government [legislative, judicial and executive] I would hope that you in the service as prosecutors at the Federal level research and be informed that such crimes against humanity must have criminal remedies pursued in the best interests of the children and the State. Where one may wonder as to the needs of the state outweighing the needs of the children, I must remind you of our Constitution and the intent of those who wrote it in an effort to give each person and their posterity what is fully embodied in the document below. I do insist under the declarations made by Special Agent Fonseca's emails that he is aware of the crime and has been obstructed by some in government position from going forward in this serious matter of Parental Abduction and interference of child custody at the state level. By reason of jurisdiction the Atlanta Police Unit for Crimes Against Children they have been obstructed by the claims of the FBI that this is a Federal matter. The existing stalemate OCI seems to have created is a violation of their powers as allowed under our Constitution for the Executive branch. With some review I believe you may have reason to further investigate this matter and the concerns of so many that await a renewal of real efforts to solve this case and proceed in the only way as a Criminal matter of the crimes that have been committed demand. It would also seem there are thousands of similar cases where the children have all grown up. There are a number of years remaining in the current children's lives as minor children. It would be a gross failure of justice and an abuse of authority on a grand scale if this matter is not resolve while these children have some childhood remaining. Please consider this carefully. No response is necessary but action to present the evidence to a Grand Jury would be appropriate after a reasonably swift forensic gathering of the existing evidence that clearly exist in this matter. Failure to do so can only create further evidence of neglect by elected and appointed official to deny the family victimized of their rights both civil and human rights. The mutual legal Assistance Treaty and the spirit of cooperation with International States makes it reasonable to believe that Warrants could be served even in Italy and overcome the adverse possession of the abducting father who lives in Italy today with all three children. The federal statute for IPK does not in any way limit the pursuit of the criminal merely because they have fled to avoid prosecution in a foreign state or a foreign country. Re: Parental Abduction: European Parliament

We now know that there was not a Hague Trial in the Sweeney-Villa abduction. Dr. Sweeney had been ordered to attend a juvenile hearing in response to the ongoing case involving Francesca Villa who had hidden in Rome and various parts of Italy with a Japonese friend who had also once lived in the US. (The story was in the Italian newspapers.)The two juveniles were caught in April 2005 by Italian police in Bologna. A juvenile court, in response to an ongoing evaluation of the Villa household, does not qualify as a Hague Court. Dr. Sweeney retains primary-joint custody, signed and agreed to by Gennaro Villa, in Waycross, Georgia, in 1997. The Sweeney-Villa children were on court-approved visitation but were not returned to Dr. Sweeney as promised by Mr. Gennaro Villa.
